RICO Allegations in Grazzini-Rucki Case


June 27, 2019: During a provocative second  interview on The David Knight Show, investigative reporter, Michael Volpe again talks about the infamous Grazzini-Rucki family court and criminal case. The interview ended abruptly after allegations of judicial misconduct and RICO corruption in Dakota County (Minnesota) were raised by Volpe, leaving listeners perched on the edge of their seats, wondering about the rest of the story.

Volpe: There is case I am working on and it is called the Rucki case. And I believe that is a perfect example of RICO. Which is the Racketeer Influenced and Corrupt Organizations Act (Wikipedia) which is a bill passed in 1970 which targeted organized crime, specifically the Mafia, however it was never intended just to take on the Mafia. And by the way if you know anything about the Mafia, RICO is one of the reasons why they are shell of their former selves.



Knight: That's right because they said these guys are getting off. They've got money to hire the best lawyers. The best lawyers are getting them off. So we're gonna take their money before we find them guilty.  We're gonna punish them in advance. And then they started using RICO against abortion protestors and so forth. They then metastasized it because that was so effective they said hey, I've got an idea we can take people's property, their cars, their homes, their cash, their planes, whatever, we don't have to find them guilty as a matter of fact, we don't have to charge them, we just have to say the property was somehow involved in transporting drugs or something and you know we can take their property without any process at all. And so this is how these kinds kinda metastasized but now it's metastasized into families.. Right?

Volpe: Sort of. Personally I do agree with you that often RICO is misused, however in this case, I believe this is a perfect example of an actual RICO enterprise that the government and media and everyone else is ignoring and effectively covering up for. What I believe is happening in the Rucki case is an example of an organized criminal enterprise which the court, the police, the prosecutors, and even FBI are looking the other way on. And RICO is charged by the Feds which means the Federal Bureau of Investigation would investigate RICO. I have gone to 3 FBI offices and been ignored. Other people have gone to even more about this case. And constantly they're ignoring us.

Knight: And tell us what is happening in this particular case. What is the RICO activity that you believe is happening?

Volpe: Alright. So essentially to sum it up, there's a lot going on. But to sum it up David Rucki is a violent man number one and he's used the courts to cover up his violence but at the same time, he is committing a series of crimes which everyone ignores. So, for instance, I discovered that since 2012, in the house that he currently lives in , the house he's lived in uninterrupted since the 1990's, he's been foreclosed on 6 times. Now it's impossible to do that and keep your house. I'm not sure if it's mortgage fraud or money laundering but that is a significant crime that I have taken to everyone and they're all ignoring it. 


So, number 2, he receives welfare and and public assistance. He receives something called Minnesota Care even though he lives in Lakeville, Minnesota, one of the most affluent suburbs in the country. Even though he owns multiple homes, a business, all of this stuff. It's blatant and obvious welfare fraud. And I think you've probably seen some articles of people like him getting busted for welfare fraud. We've seen that somewhere, right?

Knight: Well there's been, just this last week we had a millionaire who they wanted to put him on welfare roll and he said, well look, I don't want to do this and the guy said no well you qualify and we're gonna send you the money. So he went public with that. He said you know there's something fundamentally wrong with our system here. But so there's allegations and beliefs … have there been any indictments? Or charges by anybody? Or you can't get anybody who is interested in this?

Volpe: Only against his ex wife because after the courts forced their kids, and they were going to live with his sister and then transition to living with him, the two oldest daughters ran because they were afraid of what he would do to them. And she hid them. And because there was a court order through a custody order which granted him custody (was not in place when the girls ran away in April 2013) she was charged. She's a 6 time felon. He faces nothing. 

He has also embezzled from trust, from his ex wife's father to his children. And I found multiple trusts that he's done that in. Who knows how many he's actually done that in. And the whole thing...

 Why is David Rucki taking money from Albert Grazzini's Trust?

Knight: When you say that he's embezzled again has he been convicted of that? Has he been indicted?

Volpe: He has not been convicted of that however...

Knight: So these are allegations to be clear.

Volpe: The trust clearly says from Albert Grazzini to his children and for whatever reason it says withdraw to David Rucki or I think it may have even been sent to his attorney. So if it's not embezzlement, exactly what is it? So the other thing people need to understand is that there's multiple cases that interlock so what I believe he did is that he manipulated the family court case and then you leverage that family court case to be able to take control of the trust that was meant for his ex wife because she's rendered completely without any power or influence.

And so as far as the family court case, while he was accused of abuse by all of his 5 children, and by his ex wife, even though there are police reports, CPS reports of all of this abuse, the judge insisted that the kids live with him. And the judge ordered him to get 100% of the estate and sole custody and even ordered him to get child support. And that judge is named David Knutson.





Knight: We gotta take a break here Mike. And so we'll take a look at that. And again it is a very family courts and divorce courts are very messy. There's a lot of allegations that go back and forth on both sides of this. It can get pretty muddy, pretty messy. And there's not a great deal of due process. RICO IN FAMILY COURT?

David Knight raised an excellent observation that RICO abuses “metastasized” from the government taking personal property without due process to taking custody of children from parents (will add- in family court and also child protection proceedings and infringing on the rights of parents to raise children as they see fit).

Knight did not say this, but to elaborate, by misusing family court or CPS proceedings, the government has been able to unlawfully seize children from parents. Just like RICO has been used to seize property, parents can have children taken into state care or lose custody of children based on allegation alone – without ever having been charged or convicted of any crime.  Allegations can be raised by anyone – a former partner, a Guardian ad Litem, a social worker or judge, someone with a grudge etc

Knight commented on family court that “It can get pretty muddy, pretty messy..” All too often people throw their hands up at family court as being “high conflict” and problems in CPS proceedings are too often blamed on “troubled” families who bring their problems into the system. The legal process itself was designed to withstand conflict, that is why due process and other legal rights were put in place. Judges and court professionals are expected to be properly trained to deal with the issues that fall within their jurisdiction, yet the reality is that court professionals often abuse their position or are overwhelmed by the problems of the system.  

Too often, cases that are labeled “high conflict” really involve abuses of power in family court or CPS system, including due process violations. This is further compounded when parents are unable to secure adequate legal representation; and thus prevented from effectively fighting their case or being able to legally defend themselves. There is a crisis occurring in America's court system of an untold number of parents who are battling the government over the care and control of their own children.

The original intent of RICO was to deal with organized crime but has grown into a manipulation of the law, and legal proceedings, where judges, prosecutors and government officials at every level have been able to override the Constitution and trample on individual rights, and freedoms. Children have become pawns in the system and the result is broken families, and broken lives – a tragic example being the Grazzini-Rucki case.

The Grazzini-Rucki case is ground breaking because most parents caught in the system are unable to speak out, or face retaliation if they do. In this case, mother Sandra Grazzini-Rucki has been very vocal, and father, David Rucki, has also spoken publicly so that the public has been given some access into normally closed proceedings. In addition, there is a massive amount of documentation and evidence that has been posted publicly on the Grazzini-Rucki case that allows an inside look at what has happened in this case in terms of abuse allegations, how court handled safety concerns involving Sandra and the children as well as then questionable actions of the Court and it’s professionals.

Mortgage Fraud -


As his divorce was heating up, David Rucki engaged in blatant and brazen mortgage fraud.

According to the tract search, on June 3, 2011, the mortgage on Rucki’s Lakeville home was satisfied, meaning it was paid off, but inexplicably, his house was then foreclosed on- only to have him or his agents buy it back at auction every time- and sold at auction four times.

Rucki continues to own the property with numerous dubious and potentially fraudulent entries….”

Background:

The Grazzini-Rucki case made nationwide news when, in April 2013, two teenager sisters ran away when family court judge, David Knutson, attempted to reunite with them their father, David Rucki, despite allegations of domestic violence. The sisters remained in hiding for 2 years, living on a therapeutic horse ranch, while mother, Sandra Grazzini-Rucki, continued to fight in the legal system to keep the children safe, and retain custody. Throughout the course of litigation, Judge Knutson issued some of the most extreme court rulings ever recorded which ultimately left Sandra childless, homeless, and destitute while paying child support to her millionaire ex-husband (who was given 100% of the marital property in divorce proceedings, including her personal belongings).

Rucki was awarded sole custody of the five children after a bizarre custody trial in which Judge Knutson illegally detained Sandra's attorney and then forced her to proceed with trial while handcuffed and strapped to a wheelchair. It should be noted that the two oldest daughters were still missing when the custody hearing was held; meaning they were put into Rucki's custody at time they ran away to protect themselves from his alleged abuse. Further, a protective order was in place against Rucki for abuse and stalking committed against Sandra, when he was given custody. The two oldest daughters were recovered in November 2015 and continued to say they were afraid of their father, and would run if put into his custody. Their cries for help were ignored again when Judge Michael Mayer (a friend of Judge Knutson) placed them into the care of Rucki following a CHIPS hearing. At the time of the order, Rucki was on probation following a violent road rage incident where he followed then beat up a fellow motorist. After being placed back into Rucki's care, the girls were sent out of state for intensive de-programming and reunification therapy, they returned to Rucki's home but would never see their mother again. Sandra was charged with a felony for her role in assisting the girls. She raised the affirmative defense, meaning her actions were taken to protect her daughters from imminent harm, but was prevented from proving her case when 80% of defense evidence was dismissed by Judge Karen Asphaug, and then convicted of 6 felonies. Sandra has served her time in jail but continues to be trapped in the legal system with Rucki who is suing for child support, and has filed various lawsuits
